MServe shall not be liable for any direct, incidental, special, consequential, or indirect damages, including but not limited to loss of profits, revenue, data, or business opportunities. ‘Indirect damages’ refer to those that do not arise directly from a breach but occur as a secondary result, such as reputational harm or operational disruption.
Nothing in these Terms shall exclude or limit liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law. In jurisdictions where certain limitations are not allowed, MServe’s liability will be limited to 10% of the relevant invoice amount or the minimum permitted by law, whichever is lower.

If any provision of these Terms is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
SECTION 16 – SUPPORT HOURS
Customer support is available Sunday to Thursday, from 9:00 AM to 6:00 PM (KSA time), excluding official public holidays. Requests received outside these hours will be addressed on the following business day. We appreciate your understanding and cooperation.
SECTION 17 – HEALTH, SAFETY & ENVIRONMENT
Both MServe and the client shall comply with all applicable health, safety, and environmental laws and regulations. MServe personnel shall adhere to site-specific safety rules provided by the client, and the client agrees to provide a safe working environment. MServe reserves the right to suspend or refuse service if unsafe working conditions are identified.
SECTION 18 – CONFIDENTIALITY
Each party agrees to keep confidential any proprietary or sensitive information received in the course of the services. This includes but is not limited to building access codes, operational procedures, and client-related documentation. This obligation shall survive the termination of the agreement for a period of 2 years.
SECTION 19 – SERVICE LIMITATIONS
Unless explicitly stated in the service agreement, MServe shall not be responsible for structural repairs, major electrical overhauls, pest control, fire-fighting systems, or equipment replacement. These services may be arranged separately under mutually agreed terms.
SECTION 20 – CLIENT RESPONSIBILITIES
The client agrees to: (a) Provide necessary site access, approvals, and permits, (b) Ensure utility availability (water/electricity), (c) Notify MServe in writing of any hazardous materials or restricted areas, and (d) Pay service fees on time as agreed.
SECTION 21 – TERMINATION
Either party may terminate the service agreement with thirty (30) days’ written notice. MServe may terminate immediately in cases of non-payment, breach of these Terms, or safety concerns. Upon termination, all unpaid dues shall become immediately payable.
SECTION 22 – FORCE MAJEURE
Neither party shall be held liable for any delay or failure in performance due to events beyond their reasonable control, including but not limited to natural disasters, labor strikes, government restrictions, pandemics, or internet/electrical outages.
SECTION 23 – NOTICES
All notices required under these Terms shall be in writing and delivered via email, registered mail, or official client portal. Notices are deemed received: (i) upon delivery if sent by hand or courier, or (ii) 24 hours after dispatch if sent via email with confirmation of receipt.
SECTION 24 – ACCEPTANCE OF SERVICE
Upon completion of a service visit, the client or authorized representative shall sign an acknowledgment of completion or provide feedback within 48 hours. If no response is received within this period, the service will be deemed accepted.
